ABOUT THE CASE

The Court granted Landlord’s motion for summary judgment and awarded the Landlord possession of the apartment. Tenant of record had not been maintaining the subject premises as her primary residence, but never permanently vacated as she continued to sign lease renewals and pay rent. Therefore, although tenant of record was no longer entitled to the apartment her son could not claim succession.
